Terms of Service

User Term Agreement ("Agreement")


  1. Acceptance of Terms: This Agreement outlines the terms and conditions governing the use of our comprehensive car repair and maintenance platform ("Service"), commercially known as FIXLI. By accessing and using the car repair services offered by Company CHARKA MOFTAH AL-RABT AL-TAKAMLIA LALOUSATA For Brokerage Services, CR# 4030540174 (hereinafter referred to as "Provider," "We," "Us," or "Our"), you ("User") agree to comply with and be bound by the terms and conditions outlined herein. If you do not agree with any part of these terms, please refrain from using the Service.

  2. Service Description: The Provider is an intermediary agent offering automotive repair and maintenance services through the Service. These services include, but are not limited to, diagnostics, mechanical and electrical repairs, bodywork, routine maintenance, and sourcing and delivery of spare parts through exclusive partners who provide professional services. The scope of services, referred to herein as "FIXLI," may be amended from time to time, and additional terms may apply.

  3. Scheduling and Appointments: Users must schedule appointments for vehicle collection and return through the Provider's designated channels. The Provider reserves the right to reschedule or cancel appointments due to unforeseen circumstances.

  4. Vehicle Collection: and Return: Users are responsible for providing accurate details to arrange the towing services of their vehicles. The Service will coordinate with users to render the agreed-upon services. Vehicles will be collected and returned to the specified location to ensure safety and reliability. The Service will notify users upon completion of services to arrange a return time for the vehicle. Additional charges may apply for changes to return locations and for late collection.

  5. Service Charges: and Payments: Users agree to pay for the services rendered by the Service based on the agreed-upon rates. Payments are due based on stages of service delivery, with the final payment due upon completion of services. The vehicle will be returned upon completing the last payment. Late payments may incur additional charges. Diagnostic and transportation fees are non-refundable.

  6. Parts and Materials: The Service will present options for parts, which may include Refurbished, Original Equipment Manufacturers (OEM) parts, or Commercial-grade parts, depending on the repair needs and market availability. All replaced parts may be retained by the Service
    unless otherwise requested by the user.


  7. Warranty: The Service provides a limited warranty on repairs conducted. Details of the warranty period and coverage are provided separately and are subject to the terms and conditions outlined in the Limited Warranty Clause.

  8. User Responsibility: By using the Service, you agree to:
    a. Provide accurate and up-to-date information during the registration process, including any pre-existing conditions.
    b. Disclose any known vehicle issues and follow maintenance schedules as recommended by the Service.
    c. Use the platform solely for lawful purposes and in compliance with Saudi laws and regulations.
    d. Refrain from engaging in any fraudulent or malicious activities on the platform.
    e. Pay any fees or charges associated with the Service as agreed upon.


  9. Liability: While the Provider takes all necessary precautions during the repair process, users acknowledge that the Provider shall not be liable for any damages, losses, or injuries arising from the use of the Service or the services rendered by our partners. We shall not be liable for any loss of valuable items left in the vehicles.

  10. Confidentiality: The Provider respects the privacy of user information. User data collected during the service process will be handled in accordance with our Privacy Policy.

  11. Amendments to Terms: The Provider reserves the right to amend these terms at any time. Users will not necessarily be notified of any changes, and continued use of the Service implies acceptance of the updated terms. Users are urged to visit our website to review the most recent terms of service.

  12. Termination of Terms: The Provider reserves the right to refuse service, terminate agreements, cancel appointments, or suspend access to the platform at its discretion if it is believed that a user has violated any terms of this Agreement or engaged in any illegal activities.

  13. Governing Law: These terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts in the Kingdom of Saudi Arabia.

Limited Warranty

FIXLI warrants that the automotive repair and maintenance services ("Services") performed shall be free from defects in workmanship for a standard period of 14 days from the date of service completion. This Limited Warranty covers labor and materials for the repairs specifically performed as detailed in the service invoice.


Warranty Coverage:

  1. The warranty applies only to the customer whose vehicle was serviced and is non-transferable.
  2. The warranty covers the replacement of any parts found to be defective due to improper installation or if the part itself is faulty, given normal usage conditions.
  3. The warranty is valid only for the parts and services listed on the original service invoice, and any additional repairs required outside of the original service scope will be considered new services and subject to a separate charge.


Exclusions:

This Limited Warranty does not cover defects or damages attributable to or arising from:

a. Normal wear and tear, deterioration, abuse, or accidents. b. Unauthorized modifications, misuse, or work performed by a third party outside of the FIXLI network. c. Use of the vehicle in racing, competitive events, or in any manner inconsistent with the manufacturer's design or recommendations.


Warranty Claims:

To make a claim under this warranty:

  1. The customer must notify FIXLI of any defects within the warranty period and allow FIXLI an opportunity to rectify the issue.
  2. The vehicle must be presented to a FIXLI service location, or a designated partner, for assessment and any necessary repairs.
  3. The original service invoice must be presented as proof of service and to validate the warranty claim.


Remedies:

If a defect in workmanship is confirmed, FIXLI's sole and exclusive obligation, and the customer's sole and exclusive remedy, shall be, at FIXLI’s option, to either:

a. Repair the defect using new or refurbished parts that are equivalent in performance and reliability to the original part.

b. Refund the customer for the cost of the defective service.


General:

This Limited Warranty is the exclusive warranty provided by FIXLI and replaces all other warranties, express or implied. No other warranties are provided, including any implied warranties of merchantability or fitness for a particular purpose.
